The Panchayat is not represented despite service. Learned counsel for the petitioners submits that though the private respondents have obtained permission for construction of their houses under the Pradhan Mantri Abash Yojona/ Banglar Bari Prokalpo Scheme in respect of the plot no. 611 owned by them, they have encroached upon plot nos. 609, 610 and 612 belonging to the petitioners for raising such construction. The dispute between the parties is essentially civil in nature. The petitioners are at liberty to approach the appropriate civil forum for redressal of their grievance. The writ petition is not maintainable and is dismissed. There shall, however, be no order as to costs.
