A perusal of the allegations in the F.I.R. reveal that the petitioner along with 17 others have unlawfully assembled near Thuvarankurichi Bus Stand and they started going on a procession upto Boodhanayagi Amman Temple and after reaching the Temple, they have broken 108 coconuts and they have conducted poojas so that the Government of Tamil Nadu will permit the lighting of Deepam at Thiruparankundram Hill. 3. The allegations in the F.I.R. would clearly reveal that the petitioners herein along with others have only democratically expressed their dissent over the action of the Government of Tamil Nadu and they have peacefully taken a procession to reach the temple and performed their prayers in the temple. In such circumstances, the ingredients for the alleged offences under Section 189(2) and Section 292 of BNS, 2023, have not been made out. 2/4 https://www.mhc.tn.gov.in/judis 4. In view of the above said facts, if the investigation is continued, it would be caused great prejudice not only to the petitioners herein but also to the non-petitioners who are arrayed as the accused persons in the said F.I.R. 5. In view of the above said facts, F.I.R. in crime No.590 of 2025 stands quashed not only as against the petitioners but also as against the other accused persons who are the non-petitioners in this petition. 6.Accordingly, this Criminal Original Petition stands allowed.
