03/ 11.03.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Section 363/34, 366A/34, 376(3)/109, 342/34 of IPC and Sections 4 & 6 of POCSO Act
2. Heard, learned counsel for the petitioner learned counsel for the State and have also gone through the impugned order.
3. Learned Spl. P.P. opposes the prayer for bail.
4. There is allegation of rape upon the victim by the co-accused and not by the petitioner, but the from the statement of the victim it is clear that it is this petitioner who had taken the victim who is minor and handed over to that person on the pretext that she will be medically treated by him. The co-accused thereafter committed rape upon the girl. It is further apparent that the trial is in progress and six witnesses out of ten witnesses have already been examined in this case.
5. Since the trial is in progress and six witnesses out of ten witnesses have been examined, I am not inclined to grant privilege of bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with POCSO Case No.27 of 2023, arising out of T. Tanger P.S. Case No.06 of 2023, pending in the Court of learned Special Judge (POCSO), Simdega, stands rejected.
6. Accordingly, the instant bail application is dismissed.
7. It is expected that the Trial Court will conclude the trial within a period of seven months from the date of receipt a copy of this order.
