The petitioner is apprehending his arrest in connection with Jainagar P.S. Case No. 98 of 2026, registered for the offence under Section 69 of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Sub Divisional Judicial Magistrate, Koderma. 3. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in the case. He submits that what has happened that was on the instigation of the informant herself. He further submits that in the FIR itself, it has been stated that the petitioner and the informant were friend and thereafter, her marriage was solemnized with another person and false allegations are made that the petitioner has gone to the in-laws’ house and has established relationship with the informant. He next submits that the allegations are false and in view of that anticipatory bail may kindly be granted. 4. Learned counsel appearing for the State opposes the prayer and submits that the allegations are there of establishing physical relationship and not only that the petitioner has taken the photographs and made it viral and in view of that anticipatory bail may kindly be rejected. 5. On perusal of the FIR, it transpires that the petitioner and the informant were friend and later on the petitioner has refused to marry and thereafter, the marriage of the informant was solemnized with one Diwakar Rana and the allegations are made that the petitioner thereafter has gone 2026:JHHC:24692 to the house of the informant and established the relationship and taken the photograph and even made it viral. Admittedly, both are major and the relationship has been established that is one of the aspect however, taking the intimate photograph and making it viral, is a serious thing, in the attending facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner. 6.
