Heard the learned counsel appearing on behalf of the parties. 2. Learned counsel for the petitioner submits that the petitioner is in custody since 19.03.2025 in connection with S.T. No. 236 of 2025 corresponding to Basantrai P.S. Case No. 09 of 2025, G.R. No. 498 of 2025, for the alleged offence registered under Sections 103(1), 238, 3(5) of B.N.S. pending in court of learned District & Sessions Judge Vth, Godda. 3. Learned counsel for the petitioner has submitted that the petitioner happens to be the husband of the deceased. Learned counsel has further submitted that one slipper of the deceased and broken mobile of the petitioner is alleged to have been recovered from near the place of occurrence, but the petitioner has been falsely implicated in this case. Learned counsel has also submitted that two co-accused namely Bhudeo Das @ Sarvan Das @ Bhudev Das and Tuntun Tanti have been enlarged on bail by the co-ordinate bench of this Court in B.A. No. 4828 of 2025 & in B.A. No. 5846 of 2025 vide order dated 11.09.2025 and 15.09.2025 respectively. 4. Learned counsel appearing on behalf of the opposite party-State has opposed the prayer for bail and has submitted that the mobile which was found was belonging to the petitioner, who is the husband of the deceased, and has also referred to paragraph 61 of the case diary 2026:JHHC:24982 2 which also relates to the matters relating to the mobile of the petitioner. He has submitted that there is enough material to link the petitioner with the alleged offence as the mobile of the petitioner was found near the place of occurrence in broken condition. 5. So far as the other co-accused are concerned, their case stands on different footing Bhudeo Das @ Sarvan Das @ Bhudev Das was made accused on the basis of dump report of his mobile and so far as the co-accused Tuntun Tanti is concerned, he was made accused only on the ground that the husband of the deceased had saved his mobile number. 6. After hearing the learned counsel for the parties and considering the fact that material has been collected during investigation connecting the petitioner with the alleged offence and trial is going on and as per the report received from the concerned court, out of 8 charge-sheet witnesses, 2 witnesses have been examined till 12.08.2026, this Court is not inclined to enlarge the petitioner on bail. The instant bail application is hereby rejected. 7. However, the State is directed to ensure that the remaining witnesses are promptly produced before the court and the FSL report is forwarded to the court concerned at the earliest. 8. Learned counsel for the State is directed to communicate this order to the Director, Prosecution, Superintendent of Police of the concerned district and the FSL, Ranchi to ensure compliance. 9.
