GP FOR REVENUE The Court made the following ORDER: Heard the learned counsel for the petitioners and the learned Assistant Government Pleader appearing for the respondent Nos.1 to 5. 2. The issuance of notice to the 6th respondent is dispensed with, as no prejudice would cause to him, even if it is disposed of in his absence. 3. This Writ Petition is filed questioning the jurisdiction of the 4th respondent in entertaining the appeal preferred by the 6th respondent vide Rc.No.1466/2024/ROR, dated 10.12.2024. 4. The learned counsel for the petitioners submits that in the absence of the order of the 5th respondent, the 6th respondent preferred the said appeal and the same is pending consideration before the 4th respondent. 5. The learned counsel for the petitioners further seeks to raise the jurisdictional objection before the said authority also in their written statement/ counter-affidavit before the said authority, if so, the same can be considered by the said appellate authority. 6. On the other hand, the learned Assistant Government Pleader appearing for the respondent Nos.1 to 5 submits that the said appellate authority will follow the due procedure to consider the case of the petitioners as well as the 6th respondent herein. 7. In view of the above said facts and circumstances, the petitioners are permitted to file their written statement/counter-affidavit/objections for the above said appeal preferred by the 6th respondent before the 4th respondent as state above, within a period of four (04) weeks from the date of receipt of copy of this Order, by enclosing all the necessary documents in support of their claim. However, liberty is given to the petitioners to raise all the grounds both on facts and law, including the jurisdictional aspect. On receipt of the written statement/counter-affidavit/objections of the petitioners, the 4th respondent shall consider and dispose of the said appeal, strictly in accordance with law, by hearing all the parties concerned, including the petitioners and the 6th respondent, giving due opportunity, upon verification of the records and the subject land, appropriate decision shall be taken on its own merits, as expeditiously as possible, preferably, within a period of four (04) months thereafter. Pending the disposal of the above said appeal, there shall be an order of status-quo as on today to be maintained with respect to the subject land covered under the above said appeal. 8. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
