Kausik (Allowed) CRM (M) 848 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kirnahar Police Station Case No. 110 of 2025 dated October 17, 2025 under Sections 20(b)(C) of the NDPS Act. And In the matter of : Mohidul Islam ……Petitioner. Mr. Navanil De Mr. Srinjan Ghosh ……for the Petitioner. Mr. Debojyoti Deb Mr. Utsav Dutta ……for the State. Learned advocate appearing for the petitioner submits that the accusation against the petitioner and others in connection with the instant case relate to alleged recovery of 21.865 Kgs. of Ganja. Petitioner is in custody for about more than 7 and a half months. Charge sheet has already been submitted before the jurisdictional Court and the prosecution has relied upon 11 witnesses in order to prove its case. Learned advocate for the State opposes the prayer for bail. I have taken into account the quantum of seizure, the period of detention of the petitioner and the fact that charge till date has not been framed and the prosecution proposes to 2 examine 11 witnesses. Having considered the same, I am inclined to release the petitioner on bail. Accordingly, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Mohidul Islam shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, Special Court (NDPS Act), Suri, Birbhum. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Birbhum without the prior permission of the learned Special Court. With the aforesaid observations CRM (NDPS) 848 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
