The petitioners are apprehending their arrest in connection with Complaint Case No.2853 of 2022, for offence registered under section 26 of Indian Forest Act, pending in court of learned Judicial Magistrate First Class, Dhanbad. 3. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case and the allegations are made against the petitioners of encroaching the forest land. He further submits that, however, they have not encroached the forest land and Title Suit No.19 of 1998 was instituted by the forefathers of the petitioners which was decreed in favour of them and the appeal was also dismissed. 4. Learned State counsel opposes prayer and submits that allegations are there of encroaching the forest land. 5. Considering that the dispute is with regard to the encroachment of the forest land and it has been pointed out that title suit instituted by the forefathers of the petitioners was decreed in their favour and the appeal preferred against them has also been dismissed, and in that view of the matter, the petitioners, above named, are directed to surrender before learned court within two weeks from today and learned court shall release the petitioners, above named, on such terms and conditions as well as sureties as learned court may deem fit and proper. 6.
