JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused in Spl.Case.No.428/2025 pending before the Court of the Additional District and Sessions Judge, FTSC- I, Hassan, arising out of Crime No.67/2025 registered by the Hassan Women Police Station, Hassan, for offences punishable under Sections 5(j), 5(l), 5(n) and 6 of the Protection of Children from Sexual Offences Act, 2012 and Section 64 of the Bharatiya Nyaya Sanhita, 2023, is before the Court in this petition filed under Section 483 of the - 3 - HC-KAR NC: 2026:KHC:30567 CRL.P No. 5010 of 2026 Bharatiya Nagarik Suraksha Sanhita, 2023 seeking regular bail. 2. Heard learned counsel appearing for the petitioner and learned HCGP appearing for the respondent No.1- State. Respondent No.2 is served in the matter and unrepresented before this Court. 3. FIR in Crime No.67/2025 registered by the Hassan Women Police Station, Hassan, for the aforesaid offences against the petitioner herein based on the first information dated 14.08.2025 received from the victim girl, aged about 16 years 9 months. In the said case, the petitioner was arrested on 02.09.2025 and remanded to judicial custody. Investigation was subsequently completed and charge sheet was filed against the petitioner for the aforesaid offence. His bail application filed before the Trial Court in S.C.No.428/2025 was rejected on 02.12.2025. In the first information as well as in the charge sheet, it is alleged that the juvenile accused had committed penetrative sexual assault on the victim girl on 26.09.2024. It is further alleged that the victim girl and the petitioner herein were in love with each other and the petitioner allegedly had sexual intercourse with victim girl on 12.03.2025. The victim girl, who was pregnant, had given birth to a male child on 17.07.2025. The DNA test report reflects that the juvenile accused is the biological father of the child, born to the victim. The petitioner, aged 20 years is in custody from 02.09.2025. Investigation of the case is completed and charge sheet has been filed. 5. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following order: ORDER The petition is allowed. - 5 - HC-KAR NC: 2026:KHC:30567 CRL.P No. 5010 of 2026 The petitioner is directed to be enlarged on bail in S.C.No.428/2025 pending before the Court of the Additional District and Sessions Judge, FTSC-I, Hassan, arising out of Crime No.67/2025 registered by the Hassan Women Police Station, Hassan, for offences punishable under Sections 5(j), 5(l), 5(n) and 6 of the Protection of Children from Sexual Offences Act, 2012 and Section 64 of the Bharatiya Nyaya Sanhita, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; - 6 - HC-KAR NC: 2026:KHC:30567 CRL.P No. 5010 of 2026 d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
