02/21.08.2026 Heard learned counsel appearing for the petitioners and learned counsel appearing for the State.
2. The petitioners are apprehending their arrest in connection with Chandankiyari P.S. Case No.66 of 2026 dated 09.06.2026, registered for the offence under Sections 74, 115(2), 117(2), 329(3), 351(2), 3(5) of the Bharatiya Nyaya Sanhita, pending in the Court of the learned Sub-Divisional Judicial Magistrate, Bokaro.

Learned counsel appearing for the petitioners submits that due to land dispute the altercation took place. He further submits that there was free fight between the parties and for that, there are case and counter case between them. He next submits that the injury is found to be simple in nature. He also submits that the petitioners are having no criminal antecedent, as disclosed in paragraph 12 of this application. On these grounds, he submits that anticipatory bail may kindly be granted to the petitioners.

Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of assault and in view of that, the prayer for anticipatory bail may kindly be rejected.

Considering that there are case and counter case between the parties and the altercation took place due to land dispute and further, the petitioners are having no criminal antecedent, as disclosed in paragraph 12 of this application and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioners.

Accordingly, the above-named petitioners are directed to surrender before the learned Court within three weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bokaro in connection with Chandankiyari P.S. Case No.66 of 2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
