1. By the present petition, the petitioner is seeking a direction towards the respondents to decided the application of the petitioner and grant compassionate appointment to the petitioner on account of death of his father. Learned counsel for the petitioner submits that the father of the petitioner was working as Teacher at Government Middle School, Ambikapur and he died on 03/07/2023 in harness. Thereafter, the petitioner has submitted an application on 28/12/2023 before the Block Education Officer seeking an appointment on compassionate ground in lieu of the death of his father. Learned counsel further submits that the petitioner’s mother vide Annexure P-4, has also requested the Block Education Officer to grant compassionate appointment to the present petitioner, who is the son of the deceased employee. However, till date, no decision has been taken by the respondents authorities on the said applications.

Learned counsel for the State submits that the Annexure P-2, which is an application stated to be submitted by the petitioner before the Block Education Officer, in which, there is no receiving mentioned in the application, by the office of the B.E.O and even the date of submission of application has also not been mentioned in the proforma/application. However, he further submits that if the petitioner will submit a fresh application claiming the compassionate appointment on the ground of death of his father, the same shall be considered and decided within a period of fifty days, in accordance with law.
4. I have heard learned counsel for the parties, perused the pleadings and documents.

Having considered the submissions made by learned counsel for the parties and the facts and circumstances of the case, the present writ petition is disposed of with a direction to the respondents/Block Education Officer that, if the petitioner submits a fresh application for compassionate appointment on the ground of death of his father within a period of thirty days from today, the same shall be considered and decided in accordance with law within a further period of thirty days from the date of receipt of a copy of this order.
6. It is made clear that this Court has not expressed any opinion on merits of this case, it is for the competent authority to consider the claim of petitioner on its own merits. SD/-
