1. Heard Mr. Rahul Rote, learned Advocate for the Applicant and Ms. Deshmukh, learned A.P.P. for the Respondents-State. 2. By the present Application, the Applicant has sought for the following substantial relief :
“That this Hon'ble Court be pleased to release the Applicant in the Special Case No. 17 of 2026 pending before Special (POCSO) Judge, Pandharpur, Dist. Solapur for Crime No. 925 of 2025 dated 22nd November 2025 registered with Sangola Police Station, Solapur Gramin under section 64, 64 (2)(m), 108, 3(5) of Bhartiya Nyaya Sanhita and under sections 4,8 and 12 of Protection of Children From Sexual Offences Act, 2012 and under section 9, 10 and 11 of the Prohibition of Child Marriage Act, 2006.” osk 1 of

After having heard the matter for some time, Mr. Rahul Rote, learned Advocate for the Applicant, on instructions from the Applicant, seeks leave to withdraw the present Bail Application with liberty to file a fresh Bail Application before the Trial Court, in the event of change in circumstances. 4. Ms. S.N. Deshmukh, learned A.P.P. for the Respondents-State, submits that the prosecution has enlisted 19 witnesses. She submits that, out of 19 prosecution witnesses, 8 are the main witnesses who are the family members of the victim. 5. In view of the statement made by Mr. Rahul Rote, learned Advocate for the Applicant, leave is granted to withdraw the present Bail Application with liberty to file a fresh Bail Application before the Trial Court upon examination of 8 main witnesses referred to by Ms. S.N. Deshmukh, learned A.P.P., who are family members of the deceased victim, or in the event of change in circumstances. 6. If such an application is filed before the Trial Court, the same be considered on its own merits and in accordance with law. 7. The Criminal Bail Application No. 778 of 2026 is disposed of as withdrawn with aforesaid liberty.
