To call for the entire records in Cr.No.148/2025 having registered before the Respondent No.1 Police for the offence punishable Under Section 131, 316, 318, 320 of THE BHARATHIYA NYAYA SANHITHA (BNS) 2023, against the Order dated:10.02.2025 passed by the Honourable III Addl. Chief Judicial Magistrate At Bengaluru, which is pending before the above court on the file Respondent No.1 Police. - 3 - HC-KAR NC: 2026:KHC:30102 CRL.P No. 16551 of 2025 b. Peruse, hear and quash the FIR in Cr. No.148/2025 having registered before the Respondent No.1 Police for the offence punishable Under Section 131, 316, 318, 320 of THE BHARATHIYA NYAYA SANHITHA (BNS) 2023, against the Order dated:10.02.2025 passed in PCR No.15957/24 by the Honourable III Addl. Chief Judicial Magistrate At Bengaluru, as the complaint is abuse of court to meet the ends of justice. c. Grant such other relief/s as this Honourable Court deems fit to pass in the circumstances of the case to meet the ends of justice." 2. Heard Sri.H.V.Praveen Gowda, learned counsel appearing for the petitioner, Smt.M.M.Waheeda, learned HCGP appearing for respondent No.1, Sri.Rajesh A, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a Joint Affidavit along with Settlement Agreement. The joint affidavit reads as follows: “I, Sri. C Basavaraju, S/o Sri. Channappa, Aged about 65 years, R/at No.378, 8th Cross, RHCS Layout, Srigangadharakavalu, Vishwaneedam, Bengaluru 560091, do hereby solemnly affirm and state on oath as follows: I, Sri. Venkatesh D G, S/o Sri. Gopalaiah D G, Aged about 31 years, R/at No. 83, 7th Main Road, 10th Cross, - 4 - HC-KAR NC: 2026:KHC:30102 CRL.P No. 16551 of 2025 Pipeline Road, BHEL Mini Colony, Mallasandra, Dasarahali, Bengaluru 560057, do hereby solemnly affirm and state on oath as follows: 1. We state that disputes had arisen between us in relation to certain financial transactions and dealings, which ultimately resulted in the registration of Crime No.148/2025 of Bagalgunte Police Station, Bengaluru, and the consequential proceedings pending before the learned III ACJM, Bengaluru. 2. We state that during the pendency of the aforesaid proceedings, the intervention of elders and well wishers enabled us to amicably resolve all disputes and differences existing between us. 3. We state that pursuant to such settlement, we have voluntarily executed a Settlement Agreement dated 17-06-2026 without any force, coercion, undue influence or pressure from any person whatsoever. 4. We state that under the terms of the Settlement Agreement, all claims, counterclaims, disputes and differences arising out of the subject transaction have been amicably settled between us. 5. We state that the settlement has been arrived at after fully understanding its terms and consequences and that the same represents our free and voluntary decision. 6. We state that neither party has any surviving grievance, claim or demand against the other in respect of the subject matter of Crime No.148/2025 and the connected proceedings. 7. We state that Respondent No.2/Complainant has no objection whatsoever for allowing the Criminal Petition and for quashing the FIR, charge sheet, if any, and all consequential proceedings arising out of Crime No.148/2025. 8. We state that continuation of the criminal proceedings would serve no useful purpose in view of the amicable - 5 - HC-KAR NC: 2026:KHC:30102 CRL.P No. 16551 of 2025 settlement arrived at between us and would only result in unnecessary hardship and multiplicity of proceedings. 9. We state that this affidavit is being filed jointly before this Hon'ble Court for recording the compromise and settlement entered into between us. 10. We state that we respectfully pray that this Hon'ble Court may be pleased to take this Joint Affidavit and Settlement Agreement on record and pass appropriate orders in accordance with law, including quashing of all proceedings arising out of Crime No.148/2025 pending against the petitioner.” 4. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of joint affidavit filed by the parties to the lis as quoted supra and the Settlement Agreement and the offences not being against the State, I deem it appropriate to accept the joint affidavit and Settlement Agreement and terminate the proceedings against the petitioner in the subject petition. 6.
