JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners are before this Court calling in question proceedings in C.C.No.52366/2020, pending before the XI Addl. Chief Metropolitan Magistrate Court, Mayo Hall, Bengaluru, transferred from X Additional Chief Metropolitan Magistrate Court, Mayo Hall, Bengaluru, for an offence under Section 498A of Indian Penal Code. 2. Heard Sri.Shashank R, learned counsel appearing for the petitioners, Sri.B.N.Jagadeesha, learned Addl. SPP - 3 - HC-KAR NC: 2026:KHC:17956 CRL.P No. 3814 of 2026 appearing for respondent No.1, Smt.Asha M.P., learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application duly signed by counsel for the petitioners and respondent No.2 along with the affidavits of both the parties. The Compounding Application filed by petitioners and respondent No.2 reads as follows: “For the reasons stated in the accompanying affidavits, the Petitioners and Respondent No.2 pray that this Hon'ble Court may be pleased to quash the proceedings in C.C.No.52366/2020 on the file of the XI Additional Chief Metropolitan Magistrate, Mayohall, Bengaluru, arising out of Crime No.115/2019 registered by Ramamurthy Nagar Police Station, Bengaluru, for the offence punishable under Section 498A of the Indian Penal Code, in the interest of justice.” The affidavit filed by respondent No.2 reads as follows: "I, Smt. Vibha Jha, Aged about 44 years, D/o. Dinanath Jha, Flat No-A-091, DLF Maiden Heights, Rajapura, Jigani, Bengaluru City, Karnataka-560105, do hereby solemnly affirm and state on oath as follows. 1. I am the complainant in the above case and I am well acquainted with the facts of the case and competent to swear to this affidavit. 2. I had lodged a complaint before Ramamurthy Nagar Police Station, Bengaluru, against my husband and his parents, namely, Accused No. 1/Petitioner No. 1 - 4 - HC-KAR NC: 2026:KHC:17956 CRL.P No. 3814 of 2026 husband, Accused No. 2 father- in-law since deceased, and Accused No. 3/Petitioner No. 2 mother-in-law. Based on my complaint, FIR in Crime No. 115/2019 dated 20.03.2019 was registered for the offence under Section 498A of the Indian Penal Code. The case is now pending as C.C. No. 52366/2020 on the file of the XI Additional Chief Metropolitan Magistrate, Mayohall, Bengaluru. 3. My husband had filed M.C. No. 2866/2018 before the Principal Judge, Family Court, Bengaluru, on 06.06.2018 seeking dissolution of marriage. During mediation, we entered into a Memorandum of Settlement dated 08.12.2025 under Section 89 of the Code of Civil Procedure read with Rules 24 and 25 of the Karnataka Civil Procedure Mediation Rules, 2005, resolving all disputes. I agreed to cooperate for closure of the criminal proceedings in C.C. No. 52366/2020. On 08.12.2025, the Principal Judge, Family Court, Bengaluru, passed a decree of divorce in M.C. No. 2866/2018 in terms of the Memorandum of Settlement. 4. I state that the above settlement has been entered into voluntarily, out of my free will, without any coercion, undue influence or pressure from any person. I further state that I have no subsisting claims against the Petitioners. 5. In view of the settlement and dissolution of marriage, I have no objection to quashing of the proceedings in C.C. No. 52366/2020, as continuation of the same would serve no purpose. Wherefore, it is prayed that this Hon'ble Court may be pleased to quash the proceedings in C.C. No. 52366/2020 on the file of the XI Additional Chief Metropolitan Magistrate, Mayohall, Bengaluru, arising out of Crime No. 115/2019 registered by Ramamurthy Nagar Police Station, Bengaluru, for the offence punishable under Section 498A of the Indian Penal Code, in the interest of justice." 4. In the light of application for compounding being filed along with the affidavits of both the parties, and offences not being against the State, I deem it appropriate to accept the compounding application and the affidavits and terminate the proceedings against the petitioners in the subject petition. 6. For the aforesaid reasons, the following: ORDER [I] Criminal Petition is disposed. [II] Proceedings in C.C.No.52366/2020, pending before the XI Addl. Chief Metropolitan Magistrate Court, Mayo Hall, Bengaluru, transferred from X Additional Chief Metropolitan Magistrate Court, Mayo Hall, Bengaluru, stands quashed qua the petitioners.
