A perusal of the application reveals that the judgment was passed by the learned District Judge on 02.09.2025. The certified copy of the judgment was applied on 14.11.2025 and the same was supplied on 17.11.2025. After receiving the certified copy, the applicant consulted the counsel who advised him to file an appeal in this Court. Earlier, the applicant was being represented by Shri Mohinder Thakur and Shri Lal Singh, Advocates, before the learned court below. Thereafter, the copies of the orders were intermingled in the office file and could not be traced till 27.12.2025. Immediately thereafter, action was taken for the filing of the instant appeal. The delay in filing the same is neither intentional nor deliberate, but the same has occurred on account of unavoidable circumstances. Learned counsel for the non-applicants has no objection in case the application is allowed in favour of the applicant. Consequently, in view of the averments made in the application, which is duly supported by an affidavit, and in view of the submissions made by the learned counsel for the applicant, the delay in filing the appeal is condoned.
