This contempt petition has been filed against disobedience of order passed in WPS No. 6777 of 2024 dated 24.10.2024, wherein and whereby, the respondents were directed to disburse entire amount of retiral dues for which petitioner was entitled along with arrears of 10% within a period of two months, failing of disbursement within said period, amount shall carry interest @ 6%. 2. 2 24.10.2024, whereas, payment was made with delay of 7 months and 17 days, therefore, the petitioner is entitled for interest at the rate of 6% from date of order passed in writ petition till date of its realization. 3. On the other hand, Mr. Jitendra Shrivastava would submit that the respondents were granted two months time to disburse the amount of retiral dues and after expiry of two months there was delay of 5 months and 17 days in payment of gratuity, commutation of pension, 10% arrears of pension and 1 months and 17 days delay in payment of leave encashment and for said period interest at the rate of 6% has been paid. He would refer chart annexed as Annexure A/1. 4. I have heard learned counsel for the parties and perused the documents placed on record. 5. 6. Perusal of chart would show that interest part at the rate of 6% was
3 calculated after expiry of two months from date of order i.e. 24.12.2024, which appears to be proper as respondents were granted two months time to comply with the order, and thereafter, there was delay of 5 months 17 days in payment of gratuity, commutation of pension, 10% arrears of pension and 1 month and 17 days delay in payment of leave encashment and interest for said part has already been paid, in my opinion the respondent has complied with the order passed in the writ petition. 7. Accordingly, this contempt petition is hereby dismissed. However, the petitioner would be at liberty to take recourse of law, if dues have not been paid properly. Sd/-
