The complainant has filed the present complaint alleging willful disobedience of the order dated 09.07.2025 passed by the learned Single Judge of this Court in W.P.No.10354/2025 (GM- POLICE). - 3 - HC-KAR NC: 2026:KHC:30629-DB CCC No. 1303 of 2025 2. The complainant had filed the said writ petition impugning an endorsement dated 10.01.2025, whereby the complainant's application for Arms license was rejected. 3. The learned Single Judge had disposed of the writ petition by setting aside the endorsement and remitted the petitioner's representation for re-consideration in accordance with law. The Court had also directed the concerned authority to consider the complainant's contentions including reliance placed on the decision in the case of Payanthonth Moosa v. Commissioner of Land Revenue and Others1. 4. The accused has filed a compliance affidavit enclosing therewith an endorsement dated 11.11.2025, whereby the complainant's application has been rejected. The licensing authority found that there is no ground to grant new Arms license. The complainant is essentially aggrieved by the said endorsement. Since the complainant's application has been reconsidered, we are unable to accept that any proceedings, for willful disobedience of the orders of this Court, required to be initiated under the Contempt of Courts Act, 1971. We, however, clarify that this order would not preclude the complainant of availing substantive remedies in respect of the endorsement dated 11.11.2025 including by filing an appeal to the Appellate authority. 6. We also clarify that in the event the complainant files an appeal within a period of two weeks from date, the same would be considered by the concerned authority without being influenced by the question of delay.
