...CONTEMNOR Petition under Sections 10 to 12 of Contempt of Courts Act 1971 praying that in the circumstances stated in the affidavit file herein the High Court may be pleased to pleased to summon the respondent herein before this Hon'ble Court and punish him for willfully and deliberately disobeying the orders passed by this Hon'ble Court in W.P.No. 26332 of 2023 dated 29-04-2024 and grant Counsel for the Petitioner:
1. KAVITHA GOTTIPATI Counsel for the Contemnor:
2 NV,J C.C.No.3681 of 2024
1. M.V. VIJAYADITYA REDDY
3 NV,J C.C.No.3681 of 2024 The Court made the following ORDER:
Heard learned counsel for the petitioner and learned counsel for respondent. 2. Learned counsel for petitioner submits that this Court passed orders dated 29.04.2024 in W.P.No.26332 of 2023, directing the respondent to consider the applications of the petitioner dated 25.02.2024 and 12.03.2024 and pass appropriate orders as per the National Sports Code within a period of six weeks from the date of receipt of a copy of order. Even though, this order is clear and specific, the respondents without following the National Sports Code passed resolution which is in violation of the orders of this Court. Therefore, the respondent is liable for punishment under the provisions of the Contempt Act. 3. On the other hand, learned counsel for respondent filed counter, wherein at Paragraph Nos.5, 7 and 8, it is stated that the applications of the petitioner were considered and rejected by way of Annual General Body Meeting of the All India Chess Federation on the ground that the National Federation already granted affiliation in respect of one Association regarding State of Andhra Pradesh.
As per the By-laws of the National Sports Code and the National Federation cannot be permitted to grant affiliation to two associations from one State i.e., State of Andhra Pradesh. Accordingly, the National Federation resolved and the same was intimated. Therefore, the orders of this Court has been complied with. 4 NV,J C.C.No.3681 of 2024
4. Considering the submissions and on perusal of the material on record, this Court had directed the respondent to consider the applications of the petitioner with reference to the National Sports Code and pass appropriate orders. The contention of the petitioner is that, while considering the said applications, the respondents failed to refer to the National Sports Code and that the resolution passed by the All India Chess Federation is contrary to the National Sports Code. Therefore, the action of the respondents in rejecting the applications amounts to a violation and non compliance of the orders of this Court. On perusal of the material placed before this Court, this contention is not acceptable for the reason that the resolution of the All India Chess Federation indicates that as per terms and conditions of the National Sports Code itself contemplate that there shall be only one affiliated association in respect of each State. Accordingly, the resolution of the respondents is in consonance with the National Sports Code. The other contention of the petitioner is that, since the President of the respondent association was declared ineligible to hold the post by the Hon’ble Delhi High Court, any action taken by the association, including the passing of the impugned resolution, is contrary to the judgment of the Hon’ble Delhi High Court. This contention is also not accepted, as the resolution was passed by the entire Annual General Body Meeting and not by the President alone. Therefore, the orders of this Court have been duly complied with. 5 NV,J C.C.No.3681 of 2024
5.
In view of the above, this Court is not inclined to hold any contempt as against respondent. 6. Accordingly, the contempt case is closed. However, petitioner is at liberty to challenge resolution and rejection order of the respondent. Consequently, Miscellaneous Petitions, if any, shall stand closed. ________________________________ VENKATESWARLU NIMMAGADDA, J
