Order on Board 22/06/2026 Heard. The petitioner has filed the present petition seeking following reliefs:
“i. This Hon’ble Cout may direct the learned Executing Court to forthwith proceed with attachment and sale of the immovable property of the respondents, particulars whereof have already been furnished by the petitioner for satisfaction of the decree.

This Hon’ble Court may be pleased to issue an appropriate writ, order or direction directing the learned Executing Court to proceed with Execution Case (C) No. 14A/2023 in a time bound manner and to take coercive steps for realization of the decretal amount at the earliest. iii. This Hon’ble Court may be pleased to pass any other relief/order or direction as this Hon’ble Court deems fit and proper looking to the facts and circumstances of the case and in the interest of justice.

Learned counsel for the petitioner submits that the petitioner has confined the relief sought in the present petition to a limited extent, namely, issuance of direction to the learned Executing Court to expedite the execution proceedings and to decide the application preferred under Order XXI Rule 54 of the Code of Civil Procedure, 1908, within a stipulated timeframe. It is contended that the execution proceedings have remained pending since 23.08.2023 and had not attained finality despite the lapse of considerable time.

It is further submitted that although the judgment-debtors have entered appearance before the Executing Court, they have consistently delayed the proceedings by seeking adjournments on one pretext or another, thereby frustrating the expeditious enforcement of the decree. Consequently, the execution proceedings have been unduly protracted. In support of his submissions, learned counsel placed his reliance upon the decision of the Apex Court in Periyammal (Dead) through LRs and Others v. V. Rajamani and Others, (2025) 9 SCC 568.

4. I have heard learned counsel for the petitioner, perused the pleadings and documents annexed with the petition and carefully examined the order-sheets of the Executing Court.

Considering the limited grievance projected by the petitioner and considering the law laid down by the Apex Court in Periyammal (Dead) through LRs and Others (supra), this Court is of the considered view that ends of justice would be served by directing the learned Executing Court to decide the application of the petitioner filed under Order XXI Rule 54 CPC within a reasonable time frame.
6. Accordingly, the learned Executing Court is directed to consider and decide the aforesaid application, after affording due opportunity of hearing to all concerned parties, preferably within a period of one month from the date of production of a certified copy of this order.
7. The learned Executing Court shall also make all earnest endeavours to proceed and conclude the execution proceedings keeping in view the principles and directions enunciated by the Apex Court in Periyammal (Dead) through LRs and Others (supra).
