In this writ petition, the petitioner is assailing the order dated 31.10.2025 passed on I.A. No.1 in R.P. No.134/2025 (Annexure-A) by the Karnataka Appellate Tribunal. 4. Having heard the learned counsel appearing for the petitioner and upon perusal of the impugned order, I am of the opinion that no interference is called for in the exercise of writ jurisdiction under Articles 226 and 227 of the Constitution of India. The Karnataka Appellate Tribunal has rejected the application filed by the petitioner on I.A. No.1, which is discretionary in nature, and has assigned reasons for arriving at such conclusion. Therefore, I do not find any perversity or jurisdictional error calling for interference by this Court. 5. However, considering the facts and circumstances of the case, the Karnataka Appellate Tribunal is requested to expedite the proceedings in R.P. No.134/2025 and dispose of the same, in accordance with law, within an outer limit of six months from the date of receipt of a certified copy of this order. - 5 - HC-KAR NC: 2026:KHC:30992 WP No. 39338 of 2025 6. It is made clear that this Court has not expressed any opinion on the merits of the case, and all contentions of the parties are left open to be urged before the Karnataka Appellate Tribunal.
