(Presently Accused Petitioner Is In Central Jail, Alwar). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Amitabh Vijaywargia, Adv. For Respondent(s) : Mr. Rhishi Raj Singh Rathore, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 23/04/2026
1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.13/2026, registered at Police Station Bagad Tiraya, District Alwar for the offence(s) under Sections 318(2), 318(4), 319(2) and 316(2) of BNS and Section 66-D of IT Act.
2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. It is contended that a mobile phone containing Sim No.XXXXX82914 was allegedly recovered from the possession of the petitioner, however, apart from the Police Officials there is no other independent evidence corroborating the fact that the petitioner was the owner of the said mobile phone. It is also contended that during the investigation, it was revealed that the aforesaid Sim
[2026:RJ-JP:17214] (2 of 3) [CRLMB-2881/2026] was issued in the name of some other person. It is further contended that in the charge-sheet, it is stated that Rs.25,000/- amount was deposited in the account of Amar Singh son of Dhanpal and the petitioner opened that account on the basis of Aadhaar Card and PAN Card of Amar Singh. It is argued that there is no investigation with regard to the account, which is allegedly linked with the Mobile Sim No.XXXXX82914 and there is no evidence available on record to the fact that the petitioner opened the said account in the name of Amar Singh by using his Aadhaar Card and PAN Card, there are no criminal antecedents against the accused-petitioner and the accused-petitioner is in custody since
13.01.2026. It is further argued that the charge-sheet has already been submitted, the matter is exclusively triable by the Magistrate and the trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail application and contended that from the possession of the petitioner a mobile phone containing Sim No.XXXXX82914 was recovered and it was revealed from the mobile phone that the petitioner created an advertisement on OLX platform for selling the motorcycle. It is further argued that Rs.25,000/- was deposited through the Sim used by the petitioner, therefore, considering the aforesaid facts, the bail application of the accused- petitioner may be dismissed. 4. Heard and perused the material available on record. 5. Considering the arguments advanced by learned counsel for the petitioner and more particularly the fact that there is no investigation with regard to the account, which was allegedly
[2026:RJ-JP:17214] (3 of 3) [CRLMB-2881/2026] linked through mobile phone containing Sim No.XXXXX82914.
It is alleged in the charge-sheet that the petitioner by using the Aadhaar Card and PAN Card of Amar Singh opened the account in the Bank, however, the charge-sheet is silent about the said fact and there is no investigation with regard to the papers which were submitted before the Bank for opening the account. The accused- petitioner is in custody since 13.01.2026 and the trial of the case may take considerable time, therefore, without expressing anything on the merits of the case, this Court deems it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner- Talim S/o Ameen, in connection with FIR No.13/2026, registered at Police Station Bagad Tiraya, District Alwar, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
