The brief facts of the case are that Petitioner herein and respondent No.2 are husband and wife respectively. Respondent No.3 is their son. Due to disputes between the couple, Petitioner and respondent No.2 are living separately from March, 2016 onwards. Respondent No.2 herein filed MC No.41 of 2019 on the file of the Court of Judge, Family Court-cum-VIII Additional District Judge, Ongole, seeking monthly maintenance to herself and to her son. In that Maintenance Case, she also filed Crl.M.P.No.136 of 2023 seeking interim maintenance of Rs.15,000/- p.m. each to the Petitioners 2 and 3 for their livelihood. Learned Judge, Family Court by Order dated 08.05.2023 allowed the Crl.M.P.No.136 of 2023 and granted interim maintenance of Rs.10,000/- per month each to the respondents 2 and 3 herein from the date of filing of the Petition. Heard Sri G.N.V.Pulla Rao, learned counsel for the Petitioner and learned Assistant Public Prosecutor for respondent State. Perused the material on record. 3 Learned counsel for the Petitioner after arguing for some time, would submit that since the respondent No.3 is pursuing his studies and respondent No.2 is unable to maintain herself and her son(respondent No.3), let there be a direction to the trial Court for speedy disposal of MC No.41 of 2019 by granting liberty to the Petitioner to raise all the contentions before the Trial Court in the maintenance case. Learned Assistant Public Prosecutor would submit that the Court may pass appropriate orders. Considering the submissions made, the learned Judge, Family Court-cum- VIII Additional District Judge, Ongole is directed to dispose of MC No.41 of 2019 as expeditiously as possible without granting any adjournment in a casual way by mere asking and report the progress of the matter to the Registrar(Judicial) by 01.03.2026.
