The petitioner has challenged a preliminary notification bearing No.P.Bhu.Swa.1:81-82 dated 01.04.1981 issued by respondent No.3 and final notification dated 31.03.1984 issued by respondent No.1. He has sought for a writ in the nature of mandamus to direct the respondents to restore the property bearing Sy.No.206/1A, measuring 30½ guntas situated at Hinkal Grama, Mysuru district. - 3 - HC-KAR NC: 2026:KHC:27599 WP No. 54542 of 2014 3. When this petition was listed before this Court for preliminary hearing, learned counsel for respondent Nos.2 and 3 brought to the notice of the Court that the petitioner has sought allotment of developed sites in lieu of monetary compensation in terms of the Karnataka Urban Development Authorities (Allotment of Sites in lieu of Compensation for the land acquired) Rules, 2009. He submits that respondent No.3 has already issued an official memorandum dated 27.09.2023 allotting 8968 sq. ft. of developed land to the petitioner. He therefore, submits that this writ petition would not survive for consideration. 4. In view of the above, this writ petition stands dismissed. It is however open to the petitioners to pursue their claim before respondent No.3, in the event the allotment of developed sites under the Karnataka Urban Development Authorities (Allotment of Sites in lieu of Compensation for the land acquired) Rules, 2009 is not finalized.
