The petitioners have filed the bunch of these writ petitions under Article 226 of the Constitution of India seeking the following reliefs. (i) That, this Hon’ble Court may kindly be pleased to direct the respondents to release the amount of all the retiral dues including gratuity, leave encashment and other dues of the deceased employees/retired employees while serving in the establishment of respondents. (ii) That, this Hon’ble Court may kindly be pleased to to direct the respondents to pay the dues within a stipulated time frame along with the interest. (iii) Cost of the pettion may also be granted to the petitioners. 9 (iv) Any other relief, which this Hon’ble Court deems fit and proper, may also be granted to the petitioners in the interest of justice. 2. Learned counsel for the petitioners would submit that the grievance of the petitioners with regard to payment of retiral dues has already been redressed. However, there is delay in payment of dues, as such they are entitled to claim the interest on the delayed payment of retiral dues for which they seek permission of this Court to withdraw the bunch of these writ petitions with liberty to take recourse available to them under the law. 3. So far as interest is concerned, learned State counsel would submit that interest could not be paid to the petitioners because of delay tactics adopted by the petitioners. 4. In view of such circumstances, the petitioners are at liberty to take recourse available to them before the appropriate authority to claim interest of retiral dues and in case the petitioners approach the appropriate authority, the authority shall consider and decide the same, in accordance with law. 5. With the aforesaid liberty granted to the petitioners, the bunch of writ petitions are disposed of.
