JUSTICE RAVI V HOSMANI ORAL ORDER Challenging order dated 11.02.2019 passed by Prl.District and Sessions Judge, Kodagu, Madikeri, in Crl.R.P. no.133/2018 to extent of not granting fine amount of double cheque amount in revision against judgment dated 25.10.2017 passed by Prl.Civil Judge & JMFC, Somvarpet, in CC no.477/2014, this petition is filed. 2. Learned counsel for respondent is present along with respondent. Learned counsel for petitioner submits that he has instructions to explore settlement. 3. After negotiation, learned counsel submit that there is settlement and a joint memo is filed, which reads as follows: - 3 - HC-KAR NC: 2026:KHC:29779 CRL.P No. 4021 of 2019 "JOINT MEMO The CRL. PET NO. 4021/2019 filed against the order in CC.No.477/2014 respectively dated 25.10.2017 on the file of the PRL CIVIL JUDGE AND JMFC SOMWARPET AND THE ORDER DATED 11.02.2019 IN CRL. REV. PET NO. 133/2018 PASSED BY THE PRL. DISTRICT AND SESSION JUDGE KODAGU- MADIKERI And the said matter posted before Hon'ble High Court on 17.06.2026 and During the Argument both the parties intend to settle the matter amicably accordling both parties settled the matter amicably and filed this Joint memo as follows: 1. The Respondent here in above has agreed to pay the one time settlement amount of Rs.2,00,000 (Two Lakh Only) on or before 01.08.2026 to the Petitioner here in above before the PRL. CIVIL JUDGE AND JMFC SOMWARPET. 2. The Petitioner after the accepting the said settlement amount of Rs.2,00,000 from Respondent, shall not claim any farther amount from the Respondent. 3. The Respondent in case of any default of the said settlement of Rs.2,00,000 to the Petitioner has liberty to proceed against the Respondent by way of obtaining warrant against the Respondent from the Trial Court. It agreed between the parties that, Respondent as already deposited an amount of Rs.2,45,000 before the Trial Court on 20.11.2017 before the PRL. CIVIL JUDGE AND JMFC SOMWARPET and the Petitioner has at Liberty to withdraw the said amount if it not withdrawn and Respondent has no objection with respect of same. The Respondent has agreed to pay two lakh settlement amount in addition to deposited amount of Rs.2,45,000/-. 4. Hence this Joint Memo." - 4 - HC-KAR NC: 2026:KHC:29779 CRL.P No. 4021 of 2019 4. As per terms of settlement, respondent-accused present in Court has agreed to pay one time settlement amount of Rs.2,00,000/- in full and final settlement of claim of petitioner-complainant in addition to sum of Rs.2,45,000/- in deposit before trial Court, on or before 01.08.2026. 5. Learned counsel for petitioner accepts settlement and on instructions submits that petitioner shall not claim any further amount. 6. In view of settlement, order dated 11.02.2019 passed by Prl. District and Sessions Judge, Kodagu, Madikeri, in Crl.R.P.no.133/2018 and judgment dated 25.10.2017 passed by Prl.Civil Judge & JMFC, Somvarpet, in CC no.477/2014 is modified insofar as fine amount, which shall be to extent as agreed in joint memo.
