APHC010405702024 IN THE HIGHCOURT OF ANDHRA PRADESH AT AMARAVATI WRIT PETITION NO: 21296 of 2024 Bench Sr.No:-14 [3446] Advocates Association of Narsaraopet ...Petitioner Vs. The State of Andhra Pradesh and others ...Respondents ********** Advocate for Petitioner: Mr. N.V.R. Amarnath Advocates for Respondents: Mr. G. Vivekanand
CORAM: THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE CHALLA GUNARANJAN DATE : 17th March, 2026.
P C: The present Writ Petition has been filed challenging the notice, dated 27.08.2024, issued by the XIII Addl. District Judge, Narasaraopet.
2. Briefly stated, the material facts are as under: The District Magistrate, Palnadu District/respondent No.3, appears to have addressed a communication dated 29.07.2024 to the Principal District Judge, Guntur/respondent No.4, requiring him to furnish a panel of five advocates who would be considered for appointment as Additional Government Pleaders for the Court of XIII Addl. District and Sessions Judge, Narasaraopet.
3. The Principal District Judge, Guntur, appears to have issued a communication, dated 31.07.2024, within two days from the date of receipt of p. 2 HCJ & CGRJ the communication from the office of the District Magistrate, requesting the XIII Addl. District Judge, Narasaraopet, to send the names of five advocates along with bio-data and the requisite certificates in triplicate on or before
31.08.2024.
4. The XIII Addl. District Judge, Narasaraopet, then published a notice dated 27.08.2024, which is under challenge in the present petition. As per the said notice, the last date for submission of applications, instead of 19.08.2024, was extended to 29.08.2024 and therefore required the eligible candidates to submit their applications by 29.08.2024 at 5 PM.
5.
Learned counsel for the petitioner would submit that the communication dated 27.08.2024, issued by the XIII Addl. District Judge, Narasaraopet, made no sense, inasmuch as there was no date earlier fixed which required the submission of application forms by eligible candidates on or before 19.08.2024, and that for the first time the notice dated 27.08.2024 was published, inviting the applications by 29.08.2024, which gave only two days’ time to the eligible candidates for applying, which was not enough.
6. Indeed the notice dated 27.08.2024 is not happily worded. The XIII Addl. District Judge, Narasaraopet, might have overlooked the communication addressed to him by the Principal District Judge, Guntur, requiring him to submit a panel of eligible advocates on or before 31.08.2024 and that the XIII Addl. District Judge, Narasaraopet, issued the notice dated 27.08.2024, with a view to portray as if it had earlier on acted and fixed the date for receipt of p. 3 HCJ & CGRJ application as 19.08.2024, which may not be the correct position.
7. While we may be in agreement with learned counsel for the petitioner, yet it appears that even in the two days which were available, still candidates did appear to have applied, and finally, one Sri K. Seetha Ramanjaneyulu, Advocate, has since been appointed as Additional Government Pleader for the Court of XIII Addl. District and Sessions Judge, Narasaraopet, vide G.O.Rt.No.443, Law (G) Department, dated 19.12.2024.
8. Although the writ petition has been filed by the Advocates Association of Narsaraopet, interfering at this stage with the process of selection and appointment without even the selected candidate having been arrayed as a party respondent would not serve any purpose especially when it is not the case argued that the members of the Association were prevented from applying within the given time.
9. We, therefore, find no merit in the present Writ Petition, which is accordingly dismissed. No costs. Consequently, pending miscellaneous applications, if any, in this case, shall stand closed.
