Sahjahan Ali Mr. Asif Iqbal Ahmed …for the respondent nos. 14 and 15 Petitioners allege that the private-respondents have illegally changed the nature and character of a plot of land from Bastu to Doba. Petitioners lodged a complaint before various authorities including the Block Land and Land Reforms Officer. Petitioners have sought for a direction upon the respondent authorities to restrain the private- respondents from filling up the pond. Thus the petitioners have challenged the inaction on the part of the authority under the West Bengal Land Reforms Act, 1955 which is a specified Act under Section 2(r) of the West Bengal Land Reforms and Tenancy Tribunal Act, 1997. 2 In view of the availability of alternative and efficacious remedy under the 1997 Act, this Court is not inclined to entertain this writ petition. Accordingly, the writ petition stands dismissed as not entertained. It is, however, made clear that this order shall not prevent the petitioners from approaching the appropriate forum in accordance with law on the self- same cause of action.
