1. It is submitted by learned counsel for the petitioners that the case of the petitioners is that various developmental works required to be executed in Panchayat Dhangri and Doongi of Tehsil and District Rajouri, were earlier framed by the Gram Sabha under the directions of the BDO, who had, in terms of direction dated 02.05.2026, directed all Panchayat Secretaries of Block Dhangri to conduct Gram Sabha meetings in their respective Panchayats for the formulation of Capex Plan before
06.05.2026. Pursuant thereto the Gram Sabha of the petitioners had decided to frame the Capex Plan, however, the respondents later took a U-turn and prepared their own plan, which is to the detriment of the petitioners.
2. It is further submitted that the present petition has been filed in a representative capacity on behalf of all permanent members of the various Panchayats falling under Block Dhangri, Sr. No. 112

who had convened a meeting on 30.06.2026 to press for their demand that the Capex Plan drawn by them be considered. So much so, even the Deputy Commissioner, Rajouri, was also requested to examine the case of the petitioners.
3. It is further submitted by learned Senior counsel for the petitioners that the matter can be disposed of, by directing the Deputy Commissioner, Rajouri to take a holistic view as well as to consider the case of the petitioners.
4. Issue notice to the respondents.
5. Ms. Nazia Fazal, Assisting counsel appearing vice Mrs. Monika Kohli, learned Sr. AAG, accepts notice in the matter on behalf of the respondents. She expresses no objection in case the petition is disposed of at the threshold stage.
6. Having regard to the nature of controversy involved and without commenting upon the merits of the case, this petition is
disposed of by directing respondent No. 3 to treat the writ petition of the petitioners as a representation and proceed to consider it in accordance with the rules and regulations prevalent for framing of the Capex Plan and pass a speaking direction with due regard to the recommendations of the concerned Panchayat.
