P.P. …...... 02/ 10.03.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 363, 364(A)/ 302/201/120B read with Section 34 of IPC. 2. Heard, learned counsel for the petitioner learned counsel for the State and have also gone through the impugned order. 3. Learned AddI. P.P. opposes the prayer for bail. 4. Petitioner is not named in the FIR. The earlier case was registered under Section 364(A) of IPC, but later on Sections 363/ 302/201 and 120B of IPC were added. Though the name of the petitioner transpired from the confessional statement and the only material against the petitioner is the confession, but the fact which cannot be lost sight of is that the petitioner was an absconder and the chargesheet was submitted showing the petitioner as an absconder, which is apparent from the impugned order. 5. Considering the fact, at this stage, I am not inclined to grant privilege of bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with S.T. Case No.168 of 2025, arising out of Torpa P.S. Case No.10 of 2007, pending in the Court of learned District & Additional Sessions Judge-Ist, Khunti, stands rejected.
