By virtue of the order impugned, the appellant, the East Godavari District Co-operative Marketing Society Limited, Kakinada, which was respondent No.3 in the writ petition, had been directed to pay an amount of Rs.22,03,773/- on account of supply of fertilizers by the petitioner. 3. The grievance of the appellant is that the responsibility to pay ought to have been fixed not on the appellant Society but on the Horticulture Department. 2 4. We can see from the order impugned that the same is interim in nature and the writ petition is still pending before the learned single Judge. We deem it appropriate that the matter is argued before the learned single Judge and if advised, seek modification of the order impugned. 5. Registry is directed to list W.P.No.4474 of 2024 on 23.02.2026 before the learned single Judge having roster. 6. Accordingly, the Writ Appeal is disposed of. No order as to costs.
