DRB-3/S.S/134/2024-25 PASSED BY THE RESPONDENT NO. 2 I.E., DISTRICT REGISTRAR OF CO-OPERATIVE SOCIETIES, RANGE 3, BENGALURU URBAN DISTRICT, MALLESWARAM, BENGALURU 560 003, ENCLOSED AS ANNEXURE A AND ETC., THIS WP, COMING ON FOR FINAL HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Petitioner – Club is before this Court seeking for the following reliefs: "a. to issue a Writ in the nature of Certiorari by quashing Impugned Order dated 19.05.2025 bearing No.DRB-3/S.S/134/2024-25 passed by the Respondent No.2 i.e., District Registrar of Co-operative Societies, Range 3, Bengaluru Urban District, Malleswaram, Bengaluru 560 003, enclosed as Annexure-A. b. Such other further relief as may be just and necessary in the interest of justice and equity." 0 - 5 - HC-KAR NC: 2026:KHC:30379 WP No. 18661 of 2025 2.. An Internal inquiry has been carried out as regards certain allegations made in respect of excess spending etc., by the Managing Committee in the construction of the new building. The Managing Committee made out an observation and sent it back to the Enquiry Committee, pursuant to which, the review report has also been submitted. This aspect was challenged before the Registrar. The Registrar by way of the impugned order observed that the report against the Managing Committee could not have been placed before the Managing Committee, but would have to be placed before the General body vide the impugned order dated 19.05.2025 at Annexure-A. It is that order which is challenged by the Club before this Court. 3. It is rather strange that the Club has challenged the order, when the aspect relates to allegation against the Managing Committee. At the most, it could have been the Managing Committee, who could have approached this Court and not the Club. The Managing Committee could not have represented the Club and approached this Court as if the above challenge is on behalf of the entire Club. - 6 - HC-KAR NC: 2026:KHC:30379 WP No. 18661 of 2025 The entire Club can only be represented by the Governing body, more so, when the allegations are against the Managing Committee. 4. Though the submission of Sri R Kiran is that, the present Managing Committee is different from the Managing Committee, against which the allegation was made, the fact remains that there is a Managing Committee. The allegations were made against the earlier Managing Committee. The nexus between the earlier and the present Managing Committee cannot be ascertained or negated on the basis of submission made by learned counsel. 5. The submission of learned counsel is also that the revised report has been cleared by the Special General Body. The action on the part of the Managing Committee speaks volumes. 6. This Court refrains from making any comments on the same. When allegations are made against the Managing Committee, the Managing Committee cannot be authorised to accept the report against the Managing - 7 - HC-KAR NC: 2026:KHC:30379 WP No. 18661 of 2025 Committee as contented by Sri R Kiran by relying on Bylaw No.24(i) of the bylaws. The said report would have to be placed before the General body, which would have to consider the same. Hence, I do not find any infirmity in the order passed by the Registrar. The report is directed to be placed before the General body in the very next General body meeting to be held. 7. With the above observations, the petition stands dismissed.
