Hon'ble Court may be pleased to set aside the order dated 08.06.2017 and 02.05.2019, by which vakalatnama and application u/s 36(4) of the Industrial Dispute Act for permission to represent the case through lawyer/advocate on Digitally signed by NADIM MOHLE 2 behalf of the Management of SECL has been rejected. 10.3. Hon'ble Court may be pleased to permit the petitioner/SECL to represent the the case through the legal practitioner before the Labour Court in Case No. 3/ID Act/2017 (Reference). 10.4 Any other relief which this Hon'ble Court may think fit and proper in the facts and circumstance of the case may also be awarded in favour of the petitioner." 2. Mr. Pandey, learned Government Advocate appearing for the State/respondent would submit that the issue involved in the present case has already been considered and decided in WPL No. 67 of 2019, vide order dated 01.10.2019, which was subsequently affirmed by the Hon’ble Division Bench in WA No. 535 of 2019 vide judgment dated 30.09.2024. 3. Taking into consideration the submission made by Pandey, this Court is of the opinion that the present petition is squarely covered by the order passed by this Court in WPL No. 67 of 2019 (General Manager v. D.P. Saraf & Another), decided on 01.10.2019, which has been affirmed by the Hon’ble Division Bench in WA No. 535 of 2019 vide judgment dated 30.09.2024. 4.
