Heard the learned counsel appearing on behalf of the parties. 2. Learned counsel for the petitioner submits that the petitioner is in custody since 16.10.2025 in connection with Sessions Trial No.29 of 2026 arising out Manjhgaon, P.S. Case No.29 of 2025, for the alleged offence registered under section 103(1), 238 r/w section 3 (5) of the B.N.S. 2023 and under section 3/4 of Prevention of Witch (Daain) Practices Act, pending in the court of learned Additional Sessions Judge-I, West Singhbhum at Chaibsa. 3. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case. 4. However, upon a query made by this Court, learned counsel for the petitioners submits that four witnesses have been examined till today. 5. Learned counsel appearing on behalf of the opposite party-State has opposed the prayer for bail and has submitted that it is alleged that the petitioner along with co-accused took the deceased by tying her mouth with towel on motor cycle and committed rape one by one and murdered her by strangulation on her neck, on the allegation that she 2026:JHHC:24651 2 was daain and threw her dead body beneath the pool full of water. He has also submitted that at the instance of the petitioners, the blood stained cloth and other articles were recovered. The dead body was also recovered at the confessional statement of the accused persons. 6. After hearing the learned counsel for the parties and considering the nature of allegation and the recovery made at the instance of the petitioners, this Court is not inclined to enlarge the petitioners on bail. 7. The instant bail application is hereby rejected. 8. Let a copy of this order be communicated to the court concerned through ‘FAX/E-mail’.
