This Criminal Miscellaneous Petition has been filed invoking the jurisdiction of this Court under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 with the prayer to quash and set aside the entire criminal proceeding arising out of Gumla P.S. Case No. 280 of 2022 corresponding to G.R. Case No. 696 of 2023 including the cognizance order dated 10.11.2023 in the said case whereby and where under cognizance has been taken of the offences punishable under Section 3(k), 29 and 33 of the Insecticides Act, 1968 against the accused persons of the case namely Narendra Kumar Sharma, Adarsh Kumar Singh and Md. Isrial. The petitioner before this Court is M/s Bayer Crop Science Limited. [2026:JHHC:3595] 2 Cr. M.P. No.2284 of 2024 3. Learned counsel for the petitioner submits that the Bayer Crop Science Ltd. is a company incorporated under the Companies Act, 1956 and the Company Secretary of the said company vide the Letter of Authority has been authorised to conduct the business of insecticides and seeds under the Insecticides Act, hence, the Seeds Act and Rules, Regulations made there under and subsequent amendment/ modifications to sign pleadings, vakalatnama and deed etc. Hence, it is submitted that the prayer as prayed for in this Cr.M.P. be allowed. 4. Learned Spl.P.P. appearing for the State submits that since M/s Bayer Crop Science Ltd. is not an accused person of the case, hence, the sole petitioner namely M/s Bayer Crop Science Ltd. has no locus standi to challenge the order dated 10.11.2023 passed by the learned Chief Judicial Magistrate, Gumla in connection with Gumla P.S. Case No. 280 of 2022. Hence, it is submitted that this Cr.M.P. be dismissed as not maintainable at the behest of the petitioner. This submission of their learned Special Public Prosecutor is countered by the learned counsel for the petitioner by submitting that as cognizance has been taken against the Commercial Manager of the petitioner Company, without application of judicial mind and without any material available in the record, hence, this petition at the behest of the said company is maintainable. 5. Having heard the rival submissions made at the Bar and after carefully going through the materials available in the record, this Court finds that the contention of the petitioner that the cognizance has been taken against the Commercial Manager of the petitioner company is not [2026:JHHC:3595] 3 Cr. No.2284 of 2024 supported by the materials available in the record rather as already indicated above in the foregoing paragraph of this judgment, cognizance has been taken against three (3) persons in their individual capacity. 6. Under such circumstances, this Court finds force in the submission of the learned Spl.P.P. that the petitioner being not an accused persons nor an aggrieved person has no locus standi to challenge the order dated 10.11.2023 passed by the learned Chief Judicial Magistrate, Gumla in connection with Gumla P.S. Case No. 280 of 2022 corresponding to G.R. Case No. 696 of 2023. 7. Accordingly, this Criminal Miscellaneous Petition at the behest of the petitioner is dismissed being not maintainable.
