The petitioner is apprehending his arrest in connection with Complaint Case No. 5823 of 2022, registered for the offence under Section 47(a) of the Jharkhand Excise Act, pending in the court of learned Additional Chief Judicial Magistrate, Ranchi. 3. Learned counsel appearing for the petitioner submits that the petitioner has been implicated only on suspicion and the allegations are made of recovery of 1000 Kg. of Jawa Mahua along with 60 liters of prepared Jawa Mahua. He submits that in the complaint petition itself, it has been stated that however, the said Chuwai Adda was destroyed while it was being removed. He next submits that it has been recovered nearby the Swarnrekha river and that is an open space and not of the petitioner. He then submits that the petitioner has nothing to do with the said recovery and only on suspicion, the petitioner has been implicated. He also submits that the petitioner is having one criminal antecedent however, it is of the year 2022 and till date, the prosecution report has not been submitted and in that case, the petitioner has been granted anticipatory bail in that case. 4. Learned counsel appearing for the State opposes the prayer and submits that the name of the petitioner has come on suspicion and in view of that anticipatory bail may kindly be rejected. 5. Considering that that the name of the petitioner has come on suspicion and recovery has been made nearby the Swarnrekha river and that area is said to be open space and in the complaint petition itself, it has 2026:JHHC:24846 been stated that the Chuwai Adda has been destroyed while it was being removed, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Ranchi, in connection with Complaint Case No. 5823 of 2022, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
