Heard the parties. The petitioner has been made accused in connection with Jagarnathpur P.S. Case No. 170/2026 registered for the offences punishable under Sections 272/3(5) of the B.N.S., 2023 and under Sections 21(b)/22(b)/27 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was involved in sale and purchase of contrabands and from the possession of the petitioner and the co-accused persons 3.40 grams of brown sugar which is also known as ‘Heroin’ and 68 pieces of Nitroson, 10 tablets containing Alprazolam has been recovered. It is submitted that the allegation against the petitioner is false and recovered quantity of brown sugar comes under small quantity and recovered quantity of Alprazolam comes under intermediate quantity. It is next submitted that the petitioner undertakes that he will co-operate with the trial of the case and will not annoy or disturb the informant or witnesses of the case. It is lastly submitted the petitioner has been in custody since 01.07.2026 mentioned in para-06 and has no criminal antecedents as has been mentioned in para -10 of the bail application. Hence it is submitted that the petitioner be released on bail.
Learned Addl.P.P. opposes the prayer for bail. Considering the facts of this case, the above-named petitioner is
directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Commissioner Cum Special Judge (NDPS), Ranchi in connection with Jagarnathpur P.S. Case No. 170/2026 with the condition that the petitioner will co-operate with the trial of the case and will furnish his mobile number and photocopy of the Aadhar Card with an undertaking that he will not change his mobile number during the trial of the case, with further condition that he will not annoy or disturb the witnesses of the case in any manner during the trial of the case.
