Tiwari, PP HON'BLE MR. JUSTICE SAMEER JAIN Order 17/03/2026 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No. 287/2025 registered at Police Station Jamdoli District Jaipur for the offence(s) under Sections 189(2), 115(2), 126(2), 307, 109(1) of BNS. 2. Learned counsel for the accused-applicant submits that the applicant is sole bread earner of the family aged 32 years. It is submitted that the applicant is in custody from a long period and charge-sheet has been filed. It is further submitted that co- accused has already been enlarged on bail by Coordinate Bench of this Court vide order dated 23.01.2026. Learned counsel further submits that the conclusion of trial is likely to take a long time and [2026:RJ-JP:11321] (2 of 3) [CRLMB-2587/2026] no useful purpose would be served by keeping the applicant behind bars till disposal of the case. 3. Per contra, learned Public Prosecutor has vehemently opposed the bail application. It is submitted that there are five strong criminal antecedents registered against the accused- applicant. Having heard the arguments advanced by the learned counsel for the parties and considering the fact that applicant is sole bread earner of the family aged 32 years; that applicant is in custody from a long period; that charge-sheet has been filed; that co-accused has already been enlarged on bail by Coordinate Bench of this Court and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case and taking note of the fact that there are as many as five criminal antecedents registered against the applicant; that the applicant is stated to be a threat to the society if he is enlarged on bail and keeping in mind the sacrosanct objective of Indian criminal reformative system and balancing the equity between right of the liberty, strong criminal [2026:RJ-JP:11321] (3 of 3) [CRLMB-2587/2026] antecedents and young age of applicant, this Court is inclined to enlarge the accused-applicant on bail with following conditions: 4.1 That the applicant will go for his employment/work and reside 250 kms away from the place of his current residence for a period of six months. 4.2 That on every 5th of successive month, applicant will mark attendance before the jurisdictional police station. 4.3 That the concerned SHO of the present place of posting will file cancellation application if the undertaking given by the learned counsel for the applicant is not complied with regard to change of residence for the appropriate period. 5. Accordingly, the second bail application under Section 483 BNSS is allowed and it is ordered that accused-applicant Rampal @ Laxmikant Meena S/o Shri Jagdish Prasad Meena, shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
