This is the First bail application 8led under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023, for grant of regular bail to the applicants who have been arrested in connection with Crime No. 164/2025 registered at Police Station – Jainagar, District – Surajpur (C.G.), for the o>ence punishable under Section 20(B)(ii)(C) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. The prosecution story, in a nutshell, is that on 22.06.2025, during routine ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2026.03.19 15:04:00 +0530 2 vehicle checking, a Bolero vehicle bearing registration number CG 12 BC 3785 was observed approaching from the direction of Jamdei, Lakhanpur. Upon noticing the presence of the police, the driver attempted to turn the vehicle around with the apparent intent to evade checking. The said vehicle was promptly intercepted by the police party. Upon interception, three persons were found in the vehicle, out of whom one person managed to Aee towards the nearby jungle, while the remaining two occupants were apprehended at the spot. On inquiry, the apprehended persons disclosed their identities as Omprakash Basor and Motilal Basor and identi8ed the absconding individual as Krishna Basor. During the search of the vehicle bearing registration number CG 12 BC 3785, a total of 80 packets of cannabis were recovered, which were concealed in three sacks. Thereafter, a weighman, Dhananjay Yadav, was summoned to the spot, and upon weighing, the seized cannabis was found to weigh 83 kilograms and 300 grams. Accordingly, the vehicle bearing registration number CG 12 BC 3785, one mobile phone, and 83 kilograms and 300 grams of cannabis contained in three sacks were seized from the possession of accused Omprakash Basor and Motilal Basor in accordance with law. The memorandum statements of the said accused persons were duly recorded. After completion of all requisite legal formalities and proceedings at the spot, a Rojnamcha (rural police report) was prepared. On the basis of the said report, FIR No. 164/2025 was registered at Jainagar Police Station against accused Omprakash Basor and Motilal Basor for o>ences punishable under Sections 20(b)(ii) (C) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. 3. Learned counsel for the applicant submits that the present applicants have been falsely implicated in this case and the alleged contraband 3 article i.e. 83.300 Kgs of ganja was not seized from the joint possession of the present applicants and other co-accused person. He also submits that the present applicants have no criminal antecedents and they are in jail since 22.06.2025, conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the present applicants. 4. On the other hand, learned State counsel opposes the bail application of the present applicants and submits that the charge-sheet has already been submitted before the competent Court in the present case. She further submits that the quantity of contraband article i.e. 83.300 Kgs of Ganja, was recovered from the joint possession of the present applicants and other co-accused person, which is much above the commercial quantity and as such, the applicants are not entitled to be released on bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case and further the fact that the contraband article which has been seized from the joint possession of the present applicants and other co-accused person which is much above the commercial quantity and the applicants have failed to give any explanation for the same and it cannot be a case of false implication. 7. Accordingly, the bail application of the applicants – Omprakash Basor and Motilal Basor, involved in Crime No. 164/2025 registered at Police Station – Jainagar, District – Surajpur (C.G.), for the o>ence punishable under Section 20(B)(ii)(C) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, is rejected. 8.
