The complainant has filed the present complaint alleging willful disobedience of the order dated 13.12.2024 passed by the learned Single Judge of this Court in W.P.No.9443/2021 (SCST). By the said order, the learned Single Judge had directed the Deputy Commissioner to pass an order in the appeal pending before him. The Court had also made an observation to the effect that the Deputy Commissioner would also have to take into consideration the memo filed by the purchaser on 10.05.2017. - 3 - HC-KAR NC: 2026:KHC:30630-DB CCC No. 42 of 2026 2. The learned Additional Government Advocate appearing for the accused has filed a compliance affidavit enclosing therewith an order dated 31.07.2025, whereby the Deputy Commissioner has dismissed the appeal. 3. The learned counsel appearing for the complainant submits that although the appeal is dismissed, the Deputy Commissioner has also directed that the subject land shall not be alienated. 4. We are unable to accept that the order dated 13.12.2024, the disobedience of which is alleged, has not been complied with. The complaint is, accordingly, closed. 5. We, however, clarify that in the event the complainant is aggrieved by the order passed by the Deputy Commissioner, this order will not preclude the complainant from availing substantive remedies, in accordance with law.
