Petitioners take exception to the impugned order(s) dated 14.08.2026 passed by respondent No. 2, rejecting their case for grant of pension by counting the service rendered by them on contract basis as Fireman towards qualifying service under CCS Pension Rules, 1972, for grant of pension, annual increments, gratuity and leave encashment, etc. The impugned order has been passed primarily on the basis of Himachal 1 Whether reporters of the local papers may be allowed to see the judgment? 3 Pradesh Recruitment and Conditions of Service of Government Employees Act, 2024. 2. At this stage, learned Additional Advocate General has placed on record separate office instructions dated 14.09.2026 from respondent No.2 conveying that respective cases of the petitioners shall be examined afresh in accordance with law and keeping in view the decision rendered in Devinder Kumar & Ors. Vs. State of Himachal Pradesh & Anr2,. 3. It is also a matter of record that State of Himachal Pradesh & Anr. Vs.
Devinder Kumar & Ors.3 instituted by the State of Himachal Pradesh against the aforementioned judgment, has been dismissed by the Hon’ble Apex Court on 29.07.2026. While dismissing the appeal, the Hon’ble Apex Court granted four months’ time to the State Government to do the needful in terms of the judgment. 4. In view of above, impugned rejection order(s) dated 14.08.2026 (Annexure P-4 in all petitions) are quashed and set aside. The respondents are directed to re-consider the case(s) of the petitioners for the grant of relief prayed for by them, in accordance with the time-line indicated by the Hon’ble Apex Court.
