The learned counsel for the respondent State submits that the compensation has already been received by the petitioners and that is the disputed question of fact which cannot be the subject matter under Article 226 of the Constitution of India. 3. Learned counsel for the respondent no.4/ Union of India submits that the land in question has already been acquired for the 2026:JHHC:24786 3 W.P.(C) No.4521 of 2009 Cobra Battalion (CRPF) and the Cobra Battalion is in occupation of the said land. 4. At this stage, Mr. Mahadeo Thakur, the learned counsel for the petitioners seeks permission to withdraw the instant petition with liberty to move before the competent authority to decide the dispute. 5. Learned counsel for the respondent State as well as the learned counsel appearing on behalf of the respondent no.4/ Union of India have got no objection for the same. 6.
