03/13.08.2026 Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Daltonganj Town P.S. Case No.71/2026, registered for the offence under Sections 306 and 3(5) of the BNS, pending in the Court of the learned Chief Judicial Magistrate, Palamau.

Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in the case. He further submits that the petitioner is the Branch Manager of Bharat Financial Inclusion Limited. He then submits that the said company is providing loan to the ladies. He next submits that the allegations are there of misappropriation of money from the locker of the said company. By way of referring portion of the FIR, he submits that it has been clearly stated therein that Shubham Vishwakarma has taken key from the drawer of the petitioner and he has opened the locker and kept the money. He also submits that the locker was being opened utilizing both the keys. He submits that the said fact has also come in the case diary. He next submits that the CCTV camera installed in the said company also suggests so. On these grounds, he submits that anticipatory bail may kindly

be granted to the petitioner.

Learned counsel appearing for the State opposed the prayer and submits that the petitioner was connived with Shubham Vishwakarma and in view of that, the prayer for anticipatory bail may kindly be rejected.
5. In the FIR itself, the allegations are made that Shubham Vishwakarma has taken another key from the drawer of the petitioner and utilized the said key in opening the locker and keeping the money. In para 5 of the case diary, similar statements are there that the said Shubham Vishwakarma was found in the said CCTV footage and that para is silent so far as the petitioner is concerned. In the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Palamau in connection with Daltonganj Sadar P.S. Case No.71/2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
