Singh, Advocate For the State :- Mr. Pankaj Kr. Mishra, Advocate ---- 02/17.08.2026 Heard learned counsel appearing for the petitioner as well as learned counsel appearing for the State. 2. The petitioner is apprehending his arrest in connection with Chainpur P.S. Case No.223 of 2025, for the alleged offences registered under Sections 338, 336(3), 340(2), 316(2), 318(4), 3(5) and 61(2) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned Sub-Divisional Judicial Magistrate, Palamau. 3. Learned counsel appearing for the petitioner submits that so far as this petitioner is concerned, no amount has been taken by this petitioner. He next submits that the informant has alleged that one Sarita Chaudhary along with her husband Bhupendra Chaudhary have cheated many persons by using the modus operandi of providing rice and other articles. He next submits that one Afsari Khatoon was made AGM of the said company namely M/s 2026:JHHC:24710 --2-- A.B.A. No. 4575 of 2026 Bhupendra Super Market and said AGM has paid Rs. 6,30,000/- to accused Bhupendra Chaudhary. He then submits that petitioner has nothing to do with the said money. He also submits that the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-17 of the petition. He next submits that in identical situation co-accused persons have already been granted anticipatory bail by this Court in ABA Nos.2238 of 2026 and 4257 of 2026. On these grounds, he submits that anticipatory bail may kindly be provided to the petitioner. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are there of cheating the innocent persons. On this ground, he submits that anticipatory bail may kindly be rejected. 5. In the FIR allegations are made against Sarita Chaudhary and her husband Bhupendra Chaudhary of cheating several innocent persons, however, petitioner is not named in the FIR and name of the petitioner has come during course of investigation and further the petitioner is having no criminal antecedent and disclosure to that effect has been made in para-17 of the petition and in identical situation co-accused persons have already been granted anticipatory bail by this Court in the aforesaid ABAs. In the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. 6. Accordingly, the petitioner, above named, is hereby directed 2026:JHHC:24710 --3-- A.B.A. No. 4575 of 2026 to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Sub-Divisional Judicial Magistrate, Palamau in connection with Chainpur P.S.
