P.P. …...... 02/ 24.02.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 190, 191(1), 190(2), 190(3), 109, 115(2), 121(1), 121(2), 125, 132, 324(4), 351 and 352 of the Bharatiya Nyaya Sanhita and under Section 3 of Prevention of Damage to Public Property Act. 2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order. 3. Learned A.P.P. opposes the prayer for bail. 4. Petitioner is not named in the FIR and he is in custody since 18.11.2025. The allegation is that in collision between two motorcycles there persons were seriously injured were taken to the hospital where upon medical examination one of them declared dead, the mob attacked the hospital and damaged the same. 5. Admittedly, the petitioner is not named in the FIR. There is no specific allegation and chargesheet has already been submitted in this case. Co-accused has been granted bail vide order dated 29.01.2026 passed in B.A. No.204 of 2026. 6. Considering the fact that co-accused has been granted bail vide dated 29.01.2026 passed in B.A. No.204 of 2026, I am inclined to grant bail to the petitioner. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Dhanbad in connection with Dhanbad Police Station Case No.378 of 2025, subject to the condition that one of the bailors should be a close relative of the petitioner, having sufficient landed property in his own name within the State of Jharkhand.
