Accused Nos.1 and 3 in Crime No.64/2026 registered by Ajjampura Police Station, Chikkamagaluru, for the offences punishable under Sections 351(2), 329(4), 352, 115(2), 109, 118(1) and 3(5) of BNS, 2023, are before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.64/2026 was registered by Ajjampura Police Station, Chikkamagaluru, for the aforesaid offences as against Deelip and two others based on the first information dated 07.03.2026 received from Jayappa, who is one of the injured victims in the present case. Apprehending arrest in the said case, petitioners had filed Crl.Misc.No.177/2026 before the - 3 - HC-KAR NC: 2026:KHC:30409 CRL.P No. 6724 of 2026 jurisdictional Sessions Court which was rejected on 21.04.2026. Therefore, they are before this Court. 4. The material on record would go to show that accused No.2, is the direct brother of first informant. Petitioners herein are the wife and son of accused No.2. It appears that there is a long standing civil dispute between the parties and even earlier they had approached the police after having fought against each other. Insofar as present case is concerned, the alleged incident had taken place on 18.02.2026 in which accused No.1 is said to have assaulted Bharath, son of first informant and caused grievous injuries. However, first information has been submitted belatedly on 07.03.2026 which is after a delay of more than 16 days from the alleged date of incident. No satisfactory explanation is offered for the said inordinate delay in approaching the police. It is not in dispute that the injured has been discharged from the Hospital and his condition is stable . Accused No.2 has been granted anticipatory bail in the present case by the jurisdictional Sessions Court. Under the circumstances, I am of the opinion that the prayer made by the - 4 - HC-KAR NC: 2026:KHC:30409 CRL.P No. 6724 of 2026 petitioners for grant of anticipatory bail needs to be answered affirmatively. Accordingly, the following order:- 5. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No.64/2026 registered by Ajjampura Police Station, Chikkamagaluru, for the offences punishable under Sections 351(2), 329(4), 352, 115(2), 109, 118(1) and 3(5) of BNS, 2023, subject to the following conditions: 1. The Petitioners shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioners shall not tamper with the prosecution witnesses and they shall co-operate with the police for investigation and appear before them whenever called upon. - 5 - HC-KAR NC: 2026:KHC:30409 CRL.P No. 6724 of 2026 4.
