The petitioners are apprehending their arrest in connection with Deori P.S. Case No.36 of 2026, for the alleged offences registered under Sections 190/ 191(2)/ 191(3)/ 126(2)/ 127(2)/ 115(2)/ 117(2)/ 118(1)/ 109/ 76/ 79/ 303(2)/ 351(3) and 352 of Bharatiya Nyaya Sanhita, 2023, pending in the Court of learned J.M.1st Class, Giridih. 3. Learned counsel appearing for the petitioners submits that there case and counter case and both the sides are agnates. He submits that thirty-one persons have been named in the FIR. There are general and omnibus allegation. The name of the petitioners has been surfaced as because the petitioners were present there having sword in hand. He next submits that the allegation of assault by a rod is there against Shyam Das and pursuant to that injury has been received upon the husband of the informant. On these grounds, he submits that anticipatory bail may kindly be granted. 4. Learned counsel appearing for the State opposed the prayer and submits that allegation of assault is there and injury has been received by the husband of the informant. 5. From perusal of the FIR, it transpires that there are general and omnibus allegations against all the accused persons accept Shyam Das. The allegation 2026:JHHC:24912 Page | 2 A.B.A. No.4688 of 2026 against Shyam Das is that he assaulted with iron rod and the said blow was further repeated by him in pursuant to that the husband of the informant received the injury. There are case and counter case. 6. In the attending facts and circumstances of the case, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each, to the satisfaction of learned J.M.1st Class, Giridih in connection with Deori P.S. Case No.36 of 2026, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.)
