p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL No.1775 of 2026 Dilip Kumar Gouda @ Dillip Kumar Gauda … Petitioner Mr. S. Dwibedi, Advocate -versus- State of Orissa … Opposite Party Mr. P. Satpathy, Addl. PP CORAM: JUSTICE G. SATAPATHY Order No. ORDER(ORAL)01.07.2026 03. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Balliguda PS Case No.196 of 2025 corresponding to CT Case No.119 of 2025 pending in the file of learned Special Judge-cum-Addl. District and Sessions Judge, Balliguda for commission of offences punishable U/Ss. 20(b)(ii)(C)/21(b) of the NDPS Act, on the main allegation of having financial transaction with co- accused Mahendra Mallick, K. Sibaprasad Achary @ Sibaprasad Achari and Deepak Kumar Digal who were allegedly found in possession and transportation of 22Kgs of Contraband Ganja and 6 Grams of Brown Sugar. 3. Heard, Mr. Suryakanta Dwibedi, learned counsel for the petitioner and Mr. P. Satpathy, learned Additional Public Prosecutor in the matter and perused the record. p. 2 4. After having considered the rival submissions upon perusal of record, it appears from the charge sheet that the present Petitioner has been detained in custody in Baliguda PS Case No. 104 of 2025 since 04.04.2025, but the present case was detected on 01.07.2025 and the implication of the Petitioner is mainly on the basis of statement of co-accused who have allegedly stated to have financial transaction with the present Petitioner for procuring and selling of Contraband articles. The Petitioner was never apprehended in this case nor any Contraband article was found from his exclusive possession, rather the Petitioner was in custody when the present case was detected. In the aforesaid facts and situation and taking into account the materials so placed on record and keeping in view the implication of the Petitioner being on the basis of statement of co-accused, this Court considers that the Petitioner has satisfied the conditions of Sec. 37 of NDPS Act. 5. For the reasons stated hereinabove and taking into account the mode and manner of implication of present Petitioner in this case, this Court without expressing any view on merit admits the petitioner to bail. 5. Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.1,00,000/- (Rupees p. 3 One Lakh) only with two solvent sureties for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it. 6. Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e- mail for reference. (G. Satapathy) Judge Priyajit
