Even on the last date of hearing there was no representation on behalf of the respondent. 2. Revision Petitioner is willing to pay the balance amount of Rs.70,000/- in three installments and in that regard a memo is filed. Such a memo came to be filed after addressing the arguments on the merits of the matter. 3. The memo reads as under: “The petitioner hereby agrees to pay Rs.70,000/- in three installments from 25.04.2026 Rs.25,000/-, on 25.05.2026 Rs.25,000/- Rs.20,000/- on 25.06.2026.” 4. Taking note of the fact that the revision petitioner is a lady and willing to pay the entire fine amount, but seeking a little indulgence from the Court in paying the balance fine amount in three installments, even in the absence of the counsel for respondent, this Court is willing to accept the memo and dispose of the matter. - 3 - HC-KAR NC: 2026:KHC:17899 CRL.RP No. 38 of 2018 5. Hence, the following: ORDER (i) Revision Petition is disposed of. (ii) Revision Petitioner shall pay the balance amount in three installments as agreed in the memo on the respective due dates without fail. (iii) Failure to pay any one installment would automatically result in restoration of the sentence ordered by the learned Trial Magistrate confirmed by the First Appellate Court. (iv) Amount in deposit is ordered to be withdrawn by the complainant under due identification. (v) After payment of the balance amount of Rs.70,000/-, sum of Rs.10,000/- imposed by the learned Trial Magistrate confirmed by the First Appellate Court towards the defraying expenses of the State stands set aside.
