The petitioner has preferred this petition under Article 226/227 of the Constitution of India, seeking following relief(s):- 10.1 That Hon'ble Court may kindly be pleased to direct the Respondents to produce the entire records relating to the appointment process for the post of "Female Member" in District BINI PRADEEP Digitally signed by BINI PRADEEP Date: 2026.06.23 11:11:57 +0530 2 Consumer Disputes Redressal Commission in district of Balrampur-Ramanujganj. 10.2 That, Hon'ble Court may kindly be pleased to issue writ in the nature of Certiorari/Mandamus and quash the Order dated 21.11.2022 & order dated 09.02.2023 (Annexure P/1), and further direct the respondent to call the petitioner for the interview as per the selection list and process. 10.3 That, Hon'ble Court may kindly be pleased to stay the operation and effect of the further appointment process in district of Balrampur-Ramanujganj till the pendency of the instant petition in respect of post of "Female Member" in District Consumer Disputes Redressal Commission in district of Balrampur- Ramanujganj. 10.4 Any other relief, which Hon'ble Court deems fit and proper in the circumstances of the case and petition, may kindly be allowed with costs. 3. Facts of the case, in brief are that, in pursuant to the advertisement (Annexure-P/2) issued by respondent No.1 for filling up the posts of ‘Members’, in District Consumer Disputes Redressal Commission, the petitioner submitted an application for the post of “Female Member”. However, the petitioner has been declared ineligible on the ground that she does not possess the requisite experience in the prescribed field as per Clause 2.1 and 11.5 of the advertisement. Aggrieved thereby, the petitioner has preferred the present petition. 4. Learned counsel for the petitioner submits that along with the application, the petitioner had enclosed experience certificate issued by Secretary, Chhattisgarh Shabari Seva Sansthan, Bazarpara, Lakhanpur, Distt. Surguja, whereby it was certified that the petitioner had been participated in the programme relating to Children’s Rights, consumer awareness and awareness to victims of domestic violence conducted by 3 Chhattisgarh Shabari Seva Sansthan, Bazarpara, Lakhanpur, Distt. Surguja, from 01.4.2017 to till the date of issuance of certificate i.e. 20.8.2022. It is contended that the aforesaid certificate itself sufficiently demonstrates the requisite experience possessed by the petitioner and, therefore, her candidature ought to have been considered. However, despite the same, she has been declared ineligible, which is arbitrary and illegal. hence, it is prayed that this petition be allowed and the respondents be directed to consider the candidature of the petitioner for appointment to the post of ‘Female Member’ in the District Consumer Disputes Redressal Commission, District Balrampur Ramanujganj. Learned counsel further submits that though interview of the eligible candidates have already been completed, but declaration of final result has been stayed by this Court vide Order dated 24.02.2023. 5. The respondents have filed reply. Learned counsel for the State referring to its reply would submit that though the petitioner had submitted the experience certificate issued by the Secretary, Chhattisgarh Shabari Seva Sansthan, Bazarpara, Lakhanpur, Distt. Surguja, but the same was not found to be in accordance with requisite experience prescribed in the advertisement, hence, the petitioner has been declared ineligible. It is therefore, submitted that present petition is devoid of merit and deserves to be rejected. 6. Heard learned counsel for the parties and perused the material available on record. 7. As per Clause 2.1 and 11(5) of the advertisement, following eligibility criterial were required for appointment to the post of ‘Female Member’ in the District Consumer Disputes Redressal Commission, which reads as under:- 4 “2.1 अर्हता - क) आवेदक की न्यूनतम आयु पैंतीस (35) वर्ष र्होना चाहिर्हए। ख) हिकसी मान्यता प्राप्त हिवश्वहिवद्यालय से स्नातक की उपाधि% प्राप्त र्हो और ग) क्षमतावान, सत्यहिनष्ठापूर्ण और प्रधितहिष्ठत व्यहि. र्हो और उपभो.ा मामले, हिवधि% लोक मामले, प्रशाासन, अर्थशास्त्र, वाणिर्णज्य, उद्योग, हिवत्त, प्रबन्%न, अणिभयांहि8की, प्रौद्यौहिगकी, लोक स्वास्थ्य अर्थवा और्षधि% में हिवशेर्ष ज्ञान और कम से कम पन्द्रर्ह वर्ष का अनुभव रखता र्हो। XXX XXX XXX (11) आवेदन प8 के सार्थ हिनम्नलिललिखत दस्तावेज अहिनवाय रूप से संलग्न हिकया जावे । XXX XXX XXX 5. यहिद सामाजिजक क्षे8 में काय हिकये जाने का अनुभव प्रमार्ण प8 संलग्न हिकया जाता र्है तो ऐसी संस्र्था पंजीकृ त र्होना चाहिर्हए तर्था उपभो.ा मामले, हिवधि%, लोक मामले, प्रशासन, अर्थशास्त्र, वाणिर्णज्य, उद्योग, हिवत, प्रबं%न, अणिभयांहि8की, प्रौद्योहिगकीय, लोकस्वास्थ्य अर्थवा और्षधि% में संबंधि%त पदो के लिलये हिन%ारिरत अवधि% तक कायरत र्हो;” 8. Perusal of the aforesaid experience certificate submitted by the petitioner shows that she has participated in various programmes organized by the Chhattisgarh Shabari Seva Sanshan from 01.04.2007 to 20.08.2022. But it does not disclose the nature and extent of the work performed by her. It has not mentioned to the specific responsibilities undertaken by the petitioner, the role discharged by her in the programmes, or the outcome and impact of such activities. No project reports, programme details, records maintained by the institution, or any other supporting documents have been placed on record to substantiate the experience claimed by the petitioner. The contents of the certificate are too vague to establish that the petitioner possessed the requisite experience as per Clauses 2.1 and 11(5) of the advertisement, as such, holding the petitioner’s certificate not appropriate to count her experience is not found to be inappropriate or illegal. 6 10. In view of the above, this Court is not inclined to grant the relief sought by the petitioner. Accordingly, the petition is dismissed. Consequently, the interim order passed by this Court on 24.02.2023, regarding staying the declaration of final result of the interview, stands vacated. The respondents shall be at liberty to proceed further with the process of appointment to the post of Members in District Consumer Disputes Redressal Commission, Balrampur-Ramanujganj, in accordance with law. 11.
