Learned A.P.P., at the outset, submits that petitioner has antecedent of one case as pleaded in para 3 but then it has not been pleaded whether he is on bail in the said case. On which learned counsel appearing on behalf of the petitioner fairly submits that petitioner is not on bail in the said case. On which learned A.P.P. submits that no useful purpose would be served by considering the instant anticipatory bail application as petitioner is not on bail in the said case. 3. At this stage, learned counsel appearing on behalf of the petitioner seeks permission to withdraw the anticipatory bail application with liberty to the petitioner to surrender and Patna High Court CR.
